1. Our Agreement
These terms, together with the details you give us when you order, form the entire agreement between you and Rishad Nawas Limited, a New Zealand company trading as MVRK+ (“MVRK+”, “we”, “us”, “our”), for the $500 Website and the Launch Boost (the “Services”). No separate written contract is needed.
The agreement is formed when you tick the boxes on our order form to confirm the package scope and accept these terms, and then complete payment. You agree that accepting electronically is as binding as signing on paper.
If you order on behalf of a business, you confirm you’re authorised to bind that business. You must be 18 or over to order. Our other consulting services are covered by separate written agreements.
2. What’s Included in the $500 Website
A professionally designed information website for your business, which includes:
- up to 5 pages, built mobile-first;
- an enquiry form that sends enquiries to your email, and click-to-call;
- Google-ready SEO basics: page titles, descriptions and structure;
- a map, and links to your Google Business Profile and social channels;
- two rounds of changes (see section 6); and
- launch on your domain and hosting, with a check that forms and links work.
3. What’s Not Included
The $500 Website does not include, and we will not build as part of it:
- online stores or e-commerce, including product catalogues for online sale, carts and checkouts;
- online payments of any kind;
- booking, appointment or reservation systems (we can link to one you already use);
- customer logins, memberships, portals or user accounts;
- more than 5 pages;
- custom features, web apps, databases or third-party integrations;
- logo design or brand identity work;
- paid stock imagery or paid plugins beyond what we choose to use;
- domain name and hosting fees; and
- ongoing updates, maintenance, security monitoring or backups after launch.
It’s your responsibility to check this package suits your needs before you order. If you need anything on this list, choose “I’d like a call first” on the order form and we’ll quote it separately. Any additional work only starts once you’ve approved a written quote.
4. Price and Payment
Prices are in New Zealand dollars and include GST. The $500 is paid in full, in advance, by card through our payment provider, Stripe. We don’t see or store your card details. Stripe emails you a receipt.
5. How Your Build Works
Onboarding
After payment, you complete our onboarding form with your business details, content, logo and photos. You’re responsible for providing complete and accurate information. We may use suitable free stock images where you don’t provide your own.
When work starts
Work starts when we begin designing your website, usually within 1 business day of receiving your completed onboarding form. We’ll confirm by email when it starts.
Timing
Most websites are ready in about 7 days from when work starts. This is an estimate, not a guarantee, and depends on you providing content and feedback promptly.
If your onboarding shows you need more
If your answers show you need something not included (see section 3), we’ll tell you before we start. You can then accept a quote for the extra work, continue with the $500 Website as described, or cancel for a full refund.
6. Changes, Approval and Completion
Your two rounds of changes
Two rounds of changes are included. A round is one consolidated list of changes, within the scope in section 2, sent in one message. Further rounds, or changes outside the scope, may be quoted separately.
Replying to drafts
Please send feedback within 14 days of receiving a draft. If we don’t hear from you within 14 days after a reminder, we may treat that draft as approved.
Completion
The website is complete when it’s live on your domain or, if launch is delayed because domain or hosting access hasn’t been provided, 14 days after we tell you it’s ready to launch.
If we don’t hear from you
If we haven’t received your onboarding form or feedback after 30 days, we’ll check in. If there’s still no response after 90 days, we may close your project. If work hadn’t started, you’ll get a full refund. If it had, no refund is due, but we’ll send you the work completed so far on request.
7. Refund Policy
Before work starts: full refund
You can cancel for any reason before work starts (see section 5) and we’ll refund the full $500.
After work starts
Once work has started, we don’t give refunds for a change of mind, for ordering the wrong package (including if you need an online store or another feature listed in section 3), or for delays caused by missing content or feedback. Your two rounds of changes are there to get the design right.
If we can’t deliver
If we can’t deliver the website described in section 2, we’ll refund you in full.
If we decline an order
We may decline or cancel any order before work starts, for example if it isn’t a good fit for this package, and refund you in full.
How refunds are paid
Refunds go back to the card you paid with, through Stripe, and usually arrive within 5 to 10 business days. If you have a problem with a payment, please contact us before raising a dispute with your bank so we can sort it out quickly.
8. Launch Boost
Launch Boost is an optional $500 add-on where we set up and run paid ads for your business on Meta (Facebook and Instagram) and Google. The campaign details and duration are confirmed with you before it starts. You can cancel for a full refund before your ads go live. Once ads are running, ad spend already used has been paid to the ad platforms and can’t be refunded. Ad platforms set their own policies and may reject or limit ads. We can’t guarantee a particular number of clicks, enquiries or sales.
9. Domain, Hosting and Other Services
Your domain name and hosting are bought directly from the provider, in your name, so you stay in control. We recommend Hostinger. These are ongoing costs paid to that provider, not to us, and its terms and refund policy apply. We aren’t responsible for outages, price changes, security incidents or changes made by hosting providers, ad platforms or other third-party services.
10. After Launch
If something we built doesn’t work as intended within 14 days after completion, tell us and we’ll fix it at no cost. After that, and for any changes you or others make to the website, updates and support are not included and can be quoted separately. Keeping your website, hosting and content up to date after launch is your responsibility.
11. Your Content
You confirm you own or have permission to use everything you send us, including logos, photos and text, and that it’s accurate and lawful. We may refuse to publish content we reasonably consider unlawful, misleading or offensive. You’re responsible for checking your website’s information is correct before it goes live, and you agree to cover any loss we suffer from a claim that your content breaches someone else’s rights.
12. Ownership
Once paid in full, the website as delivered and your content are yours, with no lock-in contract. We keep ownership of our own tools, methods and know-how, and may reuse general techniques and layouts. Stock images, fonts and other third-party items are used under their own licences. Unless you tell us otherwise, we may show your website in our portfolio and marketing.
13. Privacy and Confidentiality
We use the information you give us only to provide the Services and to contact you about them, and we keep it confidential. Your details are handled by the services we use to run our business, including Stripe for payments. We handle personal information in line with the Privacy Act 2020, and you can ask to see or correct the information we hold about you.
14. Our Responsibility
We provide the Services with reasonable care and skill. We can’t guarantee search rankings, traffic, enquiries or sales. To the extent the law allows, we aren’t liable for any indirect or consequential loss, or for lost profits, revenue, data or opportunity, and our total liability to you for any claim is limited to the amount you paid us for the Service concerned.
15. Your Rights Under NZ Law
Nothing in these terms limits any rights you have under New Zealand law that can’t be excluded. If you’re acquiring the Services for the purposes of a business, you agree that, to the extent the law allows, the Consumer Guarantees Act 1993 does not apply, and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, and that this is fair and reasonable.
16. Events Outside Our Control
We aren’t responsible for delays or failures caused by events outside our reasonable control, such as outages of third-party services, natural disasters or illness. We’ll let you know and do our best to keep your project moving.
17. Ending the Agreement
You may cancel as set out in section 7. We may end the agreement if you seriously breach these terms, ask us to publish unlawful content, or are abusive to our team. If we end it before work starts, we’ll refund you in full. If we end it after work starts, we’ll send you the work completed so far and refund any amount we decide is fair.
18. Disputes
If you’re unhappy, please email us first and we’ll work with you in good faith to fix it within 10 business days. If we can’t agree, either of us may refer the matter to the Disputes Tribunal or the New Zealand courts.
19. General
We may update these terms from time to time. The version on this page when you pay applies to your order. If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. These terms are governed by New Zealand law.
